DEFENDANTS’ MOTION TO DISMISS COMPLAINT FOR EMERGENCY WRIT OF MANDAMUS AND OPPOSITION TO PLAINTIFF’S MOTION FOR TEMPORARY RESTRAINING ORDER AND PRELIMINARY INJUNCTION
Defendants Jeff B. Sessions, in his official capacity as Attorney General of the United States; Robin C. Ashton, in her official capacity as Counsel, Office of Professional Responsibility, U.S. Department of Justice (“DOJ”); Michael E. Horowitz, in his official capacity as DOJ Inspector General; and Christopher A. Wray, in his official capacity as Director of the Federal Bureau of Investigation (“FBI”), hereby move to dismiss this action pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6) and oppose Plaintiff’s motion for temporary restraining order and preliminary injunction. The Court is respectfully referred to the accompanying Memorandum of Points and Authorities and Proposed Order.
